Terms of Service

1. Agreement to Terms

By accessing or using bokkeh ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

bokkeh is a photography booking and studio management platform that allows photographers to:

  • Create and manage their online studio presence
  • Accept and manage client bookings
  • Process payments through manual QR/bank transfer or CHIP only
  • Showcase portfolio and galleries
  • Communicate with clients

3. User Accounts

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Upload content that infringes intellectual property rights
  • Upload harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to send spam or unsolicited communications

5. Third-Party Services

bokkeh integrates with third-party services like Google, Convex, Resend, and CHIP. CHIP is the only payment gateway currently supported by Bokkeh. Use of these services is subject to their respective terms and policies.

By using our Google integration features (Calendar, Drive), you also agree to be bound by theGoogle Terms of Service.

Important: We have restricted our Google integrations to ensure maximum privacy:

  • Drive: We only access files created by Bokkeh (`drive.file`).
  • Calendar: We only manage a specific "Bokkeh Schedule" calendar created by the app (`calendar.app.created`). We do not access your primary personal calendar.

6. Content Ownership

Your Content: You retain ownership of all content you upload (photos, text, branding). By uploading content, you grant bokkeh a license to host, display, and distribute your content as necessary to provide the Service.

Our Content: The bokkeh platform, including its design, code, and branding, is owned by bokkeh and protected by intellectual property laws.

7. Payments & Subscriptions

Subscription Access: Bokkeh is offered as a paid Business Plan for photography businesses. Public studio pages and booking access are provided as part of the active subscription.

Business Plan: Subscription fees are non-refundable, except that users may request a 50% refund within 7 days of their first subscription payment. Any usage beyond basic setup may void this refund.

Studio Refunds: Refund requests for bookings must be negotiated independently with the studio. Bokkeh is not responsible for studio-level refund disputes.

8. Business Verification (KYB)

To enable online payment collection through CHIP, the only payment gateway currently supported by Bokkeh, studios must complete a Business Verification (KYB) process. This is a one-time requirement mandated by our payment gateway provider and Bank Negara Malaysia regulations.

  • Required documents: SSM Business Registration / MyKad (IC) / Bank Statement. All documents must be valid and clearly legible.
  • Submissions are reviewed by the bokkeh admin team. You will be notified by email upon approval or rejection.
  • CHIP payment collection is hard-gated until KYB is approved. Studios may not accept online payments prior to approval.
  • If rejected, you may resubmit with corrected documents. Previously uploaded documents are permanently deleted from our storage upon resubmission.
  • Submitting false, fraudulent, or expired documents is a violation of these Terms and may result in immediate account termination.

9. CHIP Payment Gateway

bokkeh integrates with CHIP (chip-in.asia), a payment gateway licensed by Bank Negara Malaysia, to facilitate online booking payments and studio payouts. CHIP is the only payment gateway currently supported by Bokkeh; Curlec, ToyyibPay, and other gateways are not supported.

  • CHIP Collect - Business Plan: Business plan studios connect their own CHIP Brand ID and Secret Key to accept payments under their own merchant account. Requires KYB approval.
  • Platform-managed CHIP collection: Where enabled by bokkeh, studios may use a platform-managed CHIP setup to accept booking payments. Requires KYB approval.
  • CHIP Send payouts: Studios using platform-managed collection receive collected payments as automatic bank transfers via CHIP Send. Payout schedules are subject to admin configuration. Studios must register a valid Malaysian bank account and have KYB approval.
  • Any CHIP transaction or send fees are borne by the studio and are not covered by bokkeh subscription fees.

10. Booking Deposits

Studios may configure deposit requirements for bookings:

  • Full payment: the complete service fee is charged at booking.
  • Half deposit: 50% is charged upfront; the remainder is settled separately with the studio.
  • Custom deposit: a studio-defined percentage is charged upfront.

Deposit amounts and policies are set by each studio independently. Bokkeh enforces the studio's configured deposit percentage on the checkout — clients cannot alter this amount.

8. Limitation of Liability

To the maximum extent permitted by law, bokkeh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

The Service is provided "as is" without warranties of any kind, whether express or implied.

9. Indemnification

You agree to indemnify and hold harmless bokkeh from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings.

A blocked account retains existing booking records but the studio cannot accept new bookings or enable payment features until the block is lifted. Blocking does not automatically trigger refunds for existing bookings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
